ICJ snubs Pak, stays Jadhav execution till final verdict

Justice Ronny Abraham of the ICJ read out the much-awaited verdict and asserted that the case was indeed debatable, while also adding that the ICJ had prime facie jurisdiction in the case.

Baglay said Jadhav's mother had sent a petition and appeal through Indian courts against a Pakistan military court's order to hang Jadhav and hoped Islamabad to give him consular access anytime now. Ruling in favour of India, the Court asked Pakistan to keep it informed about the measures, including on consular access, taken by it in this connection.

The United Nations' top court has ordered Pakistan to stay the execution of an Indian man convicted of involvement in espionage and sabotage activities. In a statement, Shah also praised senior lawyer Harish Salve who was India's attorney at the Hague and argued the case before the global court.

Pakistan was in shock as it was confident that the ICJ will throw out the case on the grounds of jurisdiction.

No date has yet been set for Mr Jadhav's execution, although Pakistan told the ICJ during the trial that it was unlikely to happen before August 2017.

Pakistan attended the hearing at the ICJ "because of its conviction that the only way to resolve all outstanding issues is through peaceful means", it said.

"We will accept the decision of International Court of Justice on Kulbhushan", Sanaullah told reporters at the Punjab Assembly.

Pakistan claims its security forces arrested Jadhav from its restive Balochistan province on March 3 a year ago after he reportedly entered from Iran. India was able to demonstrate Pakistan's disregard for global conventions and its propensity to undermine the rule of law.

In April, a Pakistani military court had sentenced Jadhav to death.

Indian defense expert Maruf Raza has raised doubt over Indian Navy officer Kulbhushan Jadhav life. The two countries last faced off at the ICJ 18 years ago when Islamabad sought its intervention over the shooting down of its naval aircraft.
