Muslim board rejects Triple Talaq Bill

"The government should have consulted scholars of Islam before drafting the controversial bill".

"The president of the board and members will meet the Prime Minister Narendra Modi to demand to put the bill on hold", said Zafaryaab Jilani, secretary of the AIMPLB here on Sunday.

After a marathon emergency meeting, which was attended by almost 50 clerics and leaders of the community, the board's spokesperson Maulana Sajjad Nomani said that the proposed Bill was in contravention of Shariah and encroachment upon the rights of Muslim men granted in muslim personal law.

"The board had suggested that members of the community should refrain from doing so (pronouncing the instant triple talaq)", Rahmani said.

"The board believes that the bill is against the Constitution, the rights of women and Shariah".

"The Centre should withdraw the proposed bill and if it considers necessary to enact such law, it must consult Board and Muslim women organisations to redraft the bill for protecting rights of Muslim women in the country", suggested Jilani.

The Muslim Women Protection of Rights on Marriage Bill, prepared by an inter-ministerial group headed by Home Minister Rajnath Singh, will be introduced by the government in Parliament next week. The Rs Rs Muslim women (protection of rights of marriage) bill 2017 is likely to be tabled in the Lok Sabha on December 26.

Under the draft law, instant triple talaq in any form - spoken, in writing or by electronic means such as email, SMS and WhatsApp - would be bad or illegal and void.

There is also a provision of imprisonment for a term which may extend to three years and fine for violators. It also aims to provide alimony for the woman on whom instant triple talaq has been pronounced and grants her the custody of her children. It would be a non-bailable, cognisable offence. Advocate Madhavi Naik, state BJP Mahila Morcha president urged all party Members of Parliament (MPs) from both the houses to lend their support in passage of the bill that the BJP government intends to introduce in the ongoing winter session of the parliament.

"Rs Rs The terms set out in the proposed bill also encroach upon the guarantees of religious freedom and personal law given by the Indian constitution ad it is also against the judgment if the Supreme Court on August 22, 2017 which quashed the triple talaq", she added.

The Supreme Court referred to the fact that several Islamic countries like Pakistan do not allow triple talaq; judges questioned why it should not be abolished in India.

Muslims in India, majority of them followers of Hanafi school of thought, are adamant on the invalid concurrent talaq and are fighting a case with women activists in the Supreme Court.

The proposed law would only be applicable to instant triple talaq or "talaq-e-biddat" and it would give power to the victim to approach a magistrate seeking "subsistence allowance" for herself and minor children.
