It says the right to privacy "extends beyond the boundaries of a home".

"The ACDP and the majority of South Africans do not want dagga decriminalised and legalised for private use, given the high number of young people battling drug addiction".

"It will not be a criminal offence for an adult person to use or be in possession of cannabis in private space, " Judge Raymond Zondo said in handing down the judgement.

"We have used cannabis to treat anxiety, colic in children and as an antiseptic in secret for many years", said Phephsile Maseko, of the Traditional Healers Organisation.

The Western Cape High Court has previously found provisions in the Drug Act unjustifiably limited the applicants' rights to privacy.

It has been a long journey for Garreth Prince, one of the applicants in the matter, who began his fight against the criminalisation of cannabis over two decades ago, arguing that it was inconsistent with his constitutional freedom of religion as a Rastafarian.

"This Court must invoke its powers under s 172 (1) (b) of the Constitution to order a suspension of the declaration of invalidity for a realistic period to ensure Parliament may correct the defect". It also gives Parliament 24 months to change a section of the Medicine Controls Act.

South Africans have celebrated the ruling by their constitutional court and are getting ready to grow some dagga, as they call it.

Prince says cannabis should be regulated in the same way as alcohol and tobacco.

Judge Zondo said he took into account worldwide law allowing the private use of dagga at home. "Ultimately, it will be the court that will decide whether the person possessed the cannabis for personal consumption".
