John Paul Stevens says Kavanaugh shouldn't be on Supreme Court

Retired U.S. Supreme Court Justice John Paul Stevens said on Thursday that U.S. President Donald Trump's Supreme Court nominee Brett Kavanaugh does not belong on the high court, the Palm Beach Post reported. When asked his opinion on the nomination of Brett Kavanaugh, whom Stevens had once lauded, he said his views have changed after watching Kavanaugh's hearing.

"But I think that his performance during the hearings caused me to change my mind", the retired Supreme Court justice said.

According to Sotomayor, the politicization of the court has been going on for years as "political parties have adopted the academic discussions" judges were having about how best to interpret the Constitution. Several thousand protesters gathered in Washington, D.C., on Thursday, marching to the Hart Senate Office Building for a protest in the atrium, the New York Times reports. Since leaving the court, he has suggested repealing the Second Amendment as a response to the school shooting in Parkland, Florida, and has called for revising the Eighth Amendment to abolish the death penalty.

"The senators should really pay attention to it for the good of the court", Stevens said.

He criticized the First Amendment flag-burning case in 1989, and Thursday stood by the stance that the act of flag-burning should be illegal. Although a lifelong Republican, Stevens often sided with the liberal position in court rulings.

But Kavanaugh's testimony last week before the Senate Judiciary Committee was not an act of intimidation or manipulation. With a 51-seat majority, Republicans can only lose one vote - if all Democrats vote no on Kavanaugh.

If any Senators who support Kavanaugh feel the same, they haven't said so out loud.

"We live in this world where it's just the nine of us", Kagan said. Kavanaugh's statements at those hearings, Stevens said, revealed prejudices that would make it impossible for him to do the court's work, a point he said had been made by prominent commentators.

Stephen Udell, a Republican from Boca Raton, agreed that politics played a heavy hand in Kavanaugh's confirmation, but disagreed on the reason why.

Kavanaugh and California professor Christine Blasey Ford both testified in front of the Judiciary Committee on September 27 after Ford came forward with an allegation of sexual assault against the judge.

Trump, himself accused by numerous women during the 2016 presidential race of sexual misconduct, wrote on Twitter that the Federal Bureau of Investigation report showed that the allegations against Kavanaugh were 'totally uncorroborated'.
