Supreme Court sensational order on CBI

The Supreme Court on Friday, in a interim order, gave two weeks to the Central Vigilance Commission to conduct an inquiry on Verma and appointed former Supreme Court judge A.K Patnaik to monitor the CVC proceedings. M Nageswar Rao, who was asked to stand in as interim CBI chief, can not take any policy decision, said the judges.

The CVC had submitted that 10 days for the inquiry was not sufficient as it has to look into several documents.

It directed that interim CBI chief M Nageswara Rao shall not take any major policy decisions.

In an open revolt against the "Strong" Prime Minister, the CBI director on Wednesday, October 24, challenged government's decision to send him on forcible leave.

Patnaik, as chief justice of Madhya Pradesh High Court, was also a member of "In-House committee" of the apex court that probed allegations against Justice Soumitra Sen of the Calcutta High Court.

It said, the retired judge will supervise the CVC inquiry against Verma because of the importance of the case without casting aspersions on any constitutional or statutory authority.

Earlier, Congress Spokesperson Randeep Surjewala said that Gandhi and other leaders were arrested from the CBI headquarters.

On the whole, while both sides may have bones to pick with the order, the Centre is likely to be more aggrieved, since Verma's chief grievance - the orders of the CVC and Centre - could still be easily addressed subsequently by the court. He said only the PM, chief justice of India and the leader of opposition can appoint and remove the CBI director.

Long before he found himself battling corruption charges, Rakesh Asthana was the CBI's poster boy. He cited the Vineet Narain judgment to support Verma's pleas.

The BJP, therefore, thought that the three-judge SC bench vindicated the Union government's stance, which thought the SC effectively allowed the CVC to finish its probe.

In his petition Verma said "CBI´s autonomy was being compromised as certain investigations into high functionaries do not take the direction that may be desirable to the government".
