Trump had criticized Tigar after his initial decision, calling him an "Obama judge".

Nielsen made the announcement at a House Judiciary Committee hearing, telling the committee that the goal is to crack down on migrants falsely claiming asylum, only to be released into the US and escape the radar of immigration officials.

Solicitor General Noel Francisco asked the Supreme Court to greenlight the regulations pending appeal because he said they are "designed to channel asylum seekers to ports of entry, where their claims can be processed in an orderly manner; deter unlawful unsafe border crossings; and reduce the backlog of a meritless asylum claims".

"Just as we may not, as we are often reminded, 'legislate from the bench, ' neither may the Executive legislate from the Oval Office", Judge Jay Bybee, a President George W. Bush appointee, wrote for the majority in the earlier ruling.

But the Supreme Court in June backed Mr Trump in another major immigration-related case when the justices in a 5-4 ruling endorsed the legality of the Republican president's travel ban on people from several Muslim-majority nations. The statute says an asylum application must be accepted from any alien "physically present in the United States or who arrives in the United States whether or not at a designated port of arrival. irrespective of such alien's status".

The port-of-entry restrictions, due to expire after 90 days, were made through a presidential proclamation Trump issued on November 9 alongside a new administration rule. But rights groups have challenged his new rules, saying they violate administrative and immigration laws.

Last week the Trump administration went to the Supreme Court, asking the justices to put Tigar's order on hold while it appeals his ruling to the U.S. Court of Appeals for the 9th Circuit and, if necessary, the Supreme Court. Government statistics show the number of undocumented immigrants arrested near the Mexican border is less than half what it was a decade ago, the groups said.

"We are pleased the court refused to allow the administration to short-circuit the usual appellate process", Gelernt said. An open-ended nationwide injunction on enforcement issued by a San Francisco-based federal judge this week prompted the Justice Department to seek immediate relief from the Supreme Court.

"The 9th Circuit, we're going to have to look at that", Trump said, before adding that "every case" that goes through that circuit results in "an automatic loss" for his administration.
